Police Blotter: 4/10/09

Former U.S. Rep. John E. Sweeney was arrested on Apr. 5 and charged with a felony count of driving while intoxicated. This is Sweeney's second DWI arrest in less than 18 months. Getting a second DWI arrest within 10 years results in a felony charge.


Clifton Park troopers stopped Sweeney, 53, at about 3:30 a.m. Sunday on state Route 9 for speeding.

Police said they suspected Sweeney of being intoxicated, but he refused to take a sobriety test. He was subsequently arrested and charged with DWI.
His previous alcohol-related arrest was in November 2007, after police said he nearly clipped a police cruiser while driving with a blood-alcohol content of 0.18, more than twice the legal limit of 0.08.

Sweeney pleaded guilty to a misdemeanor DWI charge, was fined $1,000 and had his license suspended for six months.

He was arraigned in Clifton Park Town Court and was transported to Saratoga County Jail in lieu of $2,000 cash or $5,000 bond. He will appear in Clifton Park Town Court at a later date for sentencing.

Two juveniles were charged with third-degree burglary following a Christmas time robbery at Operation Adopt-A-Soldier's Wilton headquarters. Their names have been withheld due to their age. They were charged on Apr. 6 after the Dec. 18 burglary in which the two youths allegedly ripped open a gift basket and stole lottery tickets and at least $100 cash from the charitable group that sends care packages to American troops in Iraq and Afghanistan. They will return to court for sentencing at a later date.

Bradley J. Vandusen, 44, homeless, was arrested on Apr. 5 in connection with a robbery at Rite Aid Pharmacy. He was charged with first-degree robbery and criminal possession of stolen property after police found him in possession of anti-anxiety pills without a prescription. He will return to Saratoga Springs City Court at a later date for sentencing.

Ulysses F. McClary, 40, of 307 London Square Dr., Clifton Park, was sentenced to seven and a half years in state prison and five years of post release supervision after he pleaded guilty to a charge of first-degree criminal sex act. He was arrested on Jan. 26, 2008 in Clifton Park.

Anthony Mitchell, 57, of 204 Ferry Blvd., South Glens Falls, was sentenced to five days in Saratoga County Jail and five years probation after he pleaded guilty to a charge of operating a motor vehicle while under the influence of alcohol or drugs. He was arrested on July 4 in Moreau.

Michael L. Lyon, 45, of 111 Williams Lane, Schuylerville, pleaded guilty to a charge of fourth-degree grand larceny, a class-E felony. He was arrested on Nov. 4 for an incident that occurred on April 23, 2008. He will return to court for sentencing on May 21.

Tyler A. Mosier, 17, of 1 Park Ave., Stillwater, pleaded guilty to a charge of third-degree burglary. He was arrested on Aug. 11 for an incident that occurred on Aug. 2 in Stillwater. He will return to court for sentencing on May 21.

James T. Garnsey, 36, of 258 Broad St., Schuylerville, pleaded guilty to a charge of failure to report a change of address within 10 days. He was arrested on Jan. 20 for an incident that occurred on Jan. 14 in Saratoga Springs. He will return to court for sentencing on May 14.  

Curtis M. Patterson, 43, of 139 Juniper Dr., Ballston Spa, pleaded guilty to a charge of operation of a motor vehicle while under the influence of alcohol or drugs and was sentenced to five days in Saratoga County Jail and five years probation. He was arrested on Nov. 27 in Ballston Spa.

Barbara B. Ebert, 38, of 333 Rowland St., Lot 35, Ballston Spa, was sentenced to five days in Saratoga County Jail and five years probation after she pleaded guilty to a charge of driving while intoxicated, a class E felony. She was arrested on March 18, 2008 in Galway.

Nina M. Casale, 43, of 764 Route 9, Wilton, pleaded guilty to a charge of second-degree attempted burglary. She was arrested on Sept. 29 in Saratoga Springs. She will return to court on May 5 for sentencing.
Robert A. Lawrence, III, 38, of 184 Regent St, Saratoga Springs, pleaded guilty to a charge of second-degree criminal possession of a forged instrument after he was arrested on June 19 and 21 for incidents that occurred on June 6 and 21. He will return to court for sentencing on June 2.

Francis P. Ward, 46, homeless, pleaded guilty to a charge of failure to report a change of address within 10 days, a class-D felony. He was arrested on Feb. 5 for an incident that occurred on Jan. 12. He will return to court for sentencing on June 2.

Daniel E. Porter, 28, of 279 Sugarhill Rd., Rexford, was resentenced to one year and three months in Saratoga County Jail to run consecutively. He was originally sentenced to time served and two three-year terms of probation. He was originally convicted of misdemeanor driving while intoxicated and petit larceny.

Carl Ballard, 42, of 3901 Lewis Rd., Lot  171, Ballston Spa, was sentenced to attend drug court after being convicted of driving while intoxicated, a class-E felony. He was arrested on March 27, 2006.
