As we enter 2016, one of the most important
\nways lawmakers can ensure New York has a
\nvibrant economy is to clean-up the corruption
\nin Albany so we have an open and accountable
\nstate government.<\/p>\n

Our representative democracy was started
\nby a revolution in 1776 against the tyranny of
\na king. Today, we have a state legislature that
\nhas enabled leaders to act like despots by ceding
\ntoo much power to them for far too long.<\/p>\n

The recently convicted leaders were able to
\nsteal taxpayer dollars because of the unbridled
\npower that was given to them not by voters but
\nby majorities in each house of the legislature.<\/p>\n

Currently, the Assembly Speaker and the
\nSenate Majority Leader–no matter who they
\nare–hold enormous power to abuse the system
\nand stop bills from coming to the floor
\neven if they are mathematically sponsored by
\na majority of members from each house of
\nthe legislature (76 out of 150 in the Assembly
\nand 32 out of 63 in the Senate). The current
\nsystem illustrates less of what a representative
\ndemocracy is and more of a kingship.<\/p>\n

With the recent convictions of former Assembly
\nSpeaker Sheldon Silver and Senate
\nMajority Leader Dean Skelos, we’ve seen what
\nhappens over time when too much power
\nis consolidated into the hands of any one
\nindividual.<\/p>\n

As my colleagues point fingers at these
\npowerful leaders and lay the failure to change
\nthe system on them, those fingers point back
\nat themselves. Unless rank and file members
\nare willing to take back our state government
\nfor the people and stop the creation of slush
\nfunds and quid pro quos, we won’t be doing
\nall we can to stop this corruption.<\/p>\n

Clearly, public corruption is not a partisan
\nissue and the solution can’t be partisan in
\nnature.<\/p>\n

Unfortunately, there will always be a few
\nbad apples who game the system and betray
\ntheir oath of office. But that shouldn’t stop
\nrank and file lawmakers from taking back
\ncontrol of the agenda in Albany and stripping
\nsome of the power they have ceded to conference
\nleaders.<\/p>\n

It’s time for a rank and file member revolt
\nto say “enough is enough” and recapture the
\nSpirit of 1776 to stand up and take power back
\nfor the people.<\/p>\n

If 76 Assembly members and 32 senators
\nare sponsoring a bill it should be debated on
\nand receive an up or down vote and not held
\nin check by the whims of a leader.<\/p>\n

That’s why together with Assemblyman
\nSteve McLaughlin (R,C,I-Schaghticoke), and
\nAssemblyman Pete Lopez (R,C,I-Schoharie),
\nwe are calling for a Spirit of ’76 revolt by rank
\nand file state legislators to clean up corruption
\nand break the stranglehold on the Capitol
\nthat’s been exerted by powerful leaders who
\ntime after time have prevented common sense
\nreforms from becoming law in New York.<\/p>\n

The Spirit of ’76 bill will allow for a piece
\nof legislation that has garnered the sponsorship
\nof 76 members of the Assembly and 32
\nmembers in the Senate (both majorities representing
\nover half of the state) — regardless
\nof party affiliation — to bypass committee
\nand move to the floor for a debate and up or
\ndown vote.<\/p>\n

This measure would not guarantee a bill’s
\npassage, but it would give legislators the opportunity
\nto articulate the merits of their
\nlegislation and bring it to the floor for discussion,
\ndebate and vote.<\/p>\n

Our legislation has received the support of
\nJanice Grieshaber-Geddes, a Manlius mother
\nwho successfully advocated for passage of
\nJenna’s Law to end parole for first time violent
\nfelons after her daughter, Jenna Grieshaber,
\nwas murdered by a parolee in Albany.<\/p>\n

Jenna’s Law was a textbook example of the
\nabuse of legislative power by a leader. Former
\nAssembly Speaker Silver toyed with the Grieshabers
\nfor an entire session, ultimately holding
\nJenna’s Law from moving to the floor for a
\nvote despite it being supported and sponsored
\nby 130 out of 150 Assembly members.<\/p>\n

No one legislator should be able to wield
\npolitical power that holds up common sense
\nlegislation.<\/p>\n

The Spirit of ’76 bill will prevent leaders
\nfrom holding hostage bills that have received
\nwidespread support like what happened with
\nJenna’s Law.<\/p>\n

Leaders aren’t likely to give up their deeprooted
\npowers, but the Spirit of ’76 law could
\nmake reform a reality.<\/p>\n

The New York State Capitol is still the
\npeople’s house and not a castle for kings. It’s
\ntime rank and file legislators restore that house
