{"id":36586,"date":"2021-09-17T06:38:59","date_gmt":"2021-09-17T10:38:59","guid":{"rendered":"https:\/\/www.saratoga.com\/saratogabusinessjournal\/?p=36586"},"modified":"2021-09-17T06:38:59","modified_gmt":"2021-09-17T10:38:59","slug":"business-report-estate-planning-for-back-to-school","status":"publish","type":"post","link":"https:\/\/www.saratoga.com\/saratogabusinessjournal\/2021\/09\/business-report-estate-planning-for-back-to-school\/","title":{"rendered":"Business Report: Estate Planning For Back To School"},"content":{"rendered":"<figure id=\"attachment_33142\" aria-describedby=\"caption-attachment-33142\" style=\"width: 196px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-33142\" src=\"https:\/\/www.saratoga.com\/saratogabusinessjournal\/wp-content\/uploads\/sites\/48\/2019\/02\/verni-column-c-196x300.jpg\" alt=\"\" width=\"196\" height=\"300\" srcset=\"https:\/\/www.saratoga.com\/saratogabusinessjournal\/wp-content\/uploads\/sites\/48\/2019\/02\/verni-column-c-196x300.jpg 196w, https:\/\/www.saratoga.com\/saratogabusinessjournal\/wp-content\/uploads\/sites\/48\/2019\/02\/verni-column-c-668x1024.jpg 668w, https:\/\/www.saratoga.com\/saratogabusinessjournal\/wp-content\/uploads\/sites\/48\/2019\/02\/verni-column-c.jpg 724w\" sizes=\"auto, (max-width: 196px) 100vw, 196px\" \/><figcaption id=\"caption-attachment-33142\" class=\"wp-caption-text\">Debra Verni, principal of the Herzog Law Firm in Saratoga Springs.<\/figcaption><\/figure>\n<p>By Debra Verni<\/p>\n<p>It is that time of year when parents pack up their college bound child and drop them off at college.<span class=\"Apple-converted-space\">\u00a0 <\/span>When making a \u201cto do\u201d list of what our children need to be prepared for college the last thing on a parent\u2019s mind is estate planning or advance directives. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Have you thought about the fact that now that your child is 18, you can no longer make decisions for them, as they are an \u201cadult\u201d in the eyes of the law?<\/p>\n<p>Although we all know, \u201cadulting\u201d is overrated, just the same, your child is an adult and you can no longer make financial or health care decisions for them. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Why is this important to know?<span class=\"Apple-converted-space\">\u00a0 <\/span>When my son went away to college, I made sure he executed a health care proxy that appointed me as his agent.<span class=\"Apple-converted-space\">\u00a0 <\/span>I gave a copy of his health care proxy to student health services and after a few trips to the ER at the local hospital; they had it on file as well.<span class=\"Apple-converted-space\">\u00a0 <\/span>Without a health care proxy on file, health care providers did not have anyone to contact if my son could not make medical decisions for himself. The health care proxy gave me the ability to make health care decisions for him if he could not make decisions for himself.<\/p>\n<p><span class=\"s1\"><span class=\"s2\"><!--more--><\/span><\/span>Now that we have the heath care proxy covered, what about a power of attorney? Why would you want one for your child\/young adult?<span class=\"Apple-converted-space\">\u00a0 <\/span>A power of attorney allows you to step into the shoes of your child.<span class=\"Apple-converted-space\">\u00a0 <\/span>With a valid power of attorney, you will have access to all of their accounts if something goes wrong, you can communicate with the Financial Aid Office and have access to Medical records as well as any other financial information. <span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>I know it sounds like \u201chelicopter parenting\u201d, but when the school does not receive the checks from the student loans or the rent is not paid they are ready to boot your child out of college, you have the power to make phone calls to find out what is going on.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>I know it is a lot to think about when all you want is for your child to be safe and excel at school, but if your child has these documents in place, you have everything covered.<span class=\"Apple-converted-space\">\u00a0 <\/span>It is an awful feeling to be hundreds of miles from your child when something goes wrong and you have no power to help them.<span class=\"Apple-converted-space\">\u00a0 <\/span>The good news is that health care proxies and powers of attorney do not have an expiration date. My son has been out of school for several years and his documents are still valid.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>He recently had surgery and when he came out of surgery he told me, they asked if he had a Will.<span class=\"Apple-converted-space\">\u00a0 <\/span>I said a living will.
